General Information About North Dakota Public Records and Laws
In North Dakota, public records information is readily available to those who request it. The North Dakota Open Records Laws provide this level of protection for individuals and businesses who need access to information. The law also outlines what is considered a public record and the duties that government agencies must perform in order to provide this information to those who request it. In addition, the agency provides information regarding what is considered private information, or documents and details not available to just anyone.
 
What Is a Public Record Here?
 
In North Dakota, public records laws provide specific information about what is considered an available record. Not all information is. The state does provide protection from confidential information and records that would infringe upon public safety. In short, any document, information, recording or other piece of information, in any form, that is obtained by, organized, maintained or otherwise in the hands of a government agency must be given to the individual upon request and is a public record. There are restrictions on some specific types of information.
 
Exemptions to these public records are in the form of several things. This is not an exhaustive list.
 
·         Any information considered to be private in nature, such as information that would violate state or federal privacy laws
·         Documents and information related to an ongoing case
·         Information related to medical records of an individual
·         All documents related to an individual's student record
·         Any identifiable information regarding a medical examiner's duties unless required by law enforcement or prosecutors
·         Government information that could cause a risk to a government agency or to an individual if made available
·         Other information specifically protected under federal laws
 
In addition, most court case records are available, but in some cases, a judge can order information to be sealed. This sealing is meant to protect victims, juveniles or specific information in regards to the safety and welfare of individuals.
 
Obtaining Public Records
 
In North Dakota, public records laws state that individuals must be given access to all available public records upon request. However, some information may not be readily available. In this case, individuals may need to make a formal, written request to the department. Most departments are available during normal business hours.
 
Information may be available immediately upon request from the department. Some information is available immediately online or through third party organizations. The following agencies govern some of the state's specific public records.
 
·         Vital statistics are available through the North Dakota Department of Health, Vital Records, at the county and state level.
·         Business and organization information and public record details are available through the Attorney General's Office or the Secretary of State, Business Information Registration Department.
·         Criminal records are available through the Bureau of Criminal Investigation, Criminal Records Section.
·         Statewide court records are available through the Court Administrator at the state supreme court but also through local courts.
