General Information On South Carolina Criminal Records
For those in South Carolina, criminal records provide an important resource for learning the background of an individual. The state is an open records state. This means that the state considers this type of record available to the public in most instances. Open records are available to the public, businesses and organizations based on a request. It is possible to gather information from these records online or in person through the proper authoritative organizations. Criminal records can contain sensitive data and individuals may wish to obtain a copy of their own record for assurance of accuracy.
In the state of South Carolina, criminal records information is available only for some people. A criminal record is not created for everyone - just for those who commit a criminal act and are charred with and/or convicted of the act. When this happens, individuals will have a file with the South Carolina Law Enforcement Division or SLED. This organization maintains all records of charges or convictions in closed or ongoing investigations from all towns, counties, incorporated cities and for the state in one, computerized database. This database is searchable for those who would like to verify their own record or those of another.
The South Carolina Law Enforcement Division maintains all criminal record in a computerized database for the benefit of law enforcement and the public. This information is maintained at the state level - not necessarily connected to the federal charges an individual may face. For federal charges and criminal records, the Federal Bureau of Investigations is the only resource. However, The Central Records Repository is the location that stores this information. This includes all arrest records. Individuals can request a copy of this information in several ways.
It is possible to visit or write to the agency with a request for information on a specific person. To do so, send as much information as possible to the agency, including the individual's full, legal name, date of birth, Social Security information or other data. The following address is used:
South Carolina Law Enforcement Center
4400 Broad River Road
Columbia, South Carolina 29221
It is also possible to request information from the agency over the phone. To do so, follow the prompts at 803 737-9000. There is a fee of $25 for accessing these records. This administrative fee covers processing. It is not possible for individuals or businesses to access federal records or criminal records housed by the FBI. Gathering this information at the state level does have restrictions. No juvenile records are available through this database. That information remains protected and confidential at least until the individual turns 18, per South Carolina law.
For those who wish to access South Carolina criminal records, gather as much information as possible about the individual. It is possible to obtain this information about yourself as well. In situations where errors are found on the records, individuals will need to contact the jurisdiction reporting the information - not the SLED, for corrections. This process can take some time.
