North Dakota Criminal History Search Information
Have you ever been arrested or taken to court over something? If so, it might not be much of a deal, but if you had some serious transgressions in the past, they could surface to hurt you in the future if someone checks your North Dakota criminal record. You should make sure that your record is accurate an up to date and see if there are things you can delete or amend. Here is important information to help you.

What is Your Criminal Record?

Criminal records may contain any and all information about legal issues you have experienced. For example, if you were arrested and fingerprinted, then this information is probably on your record. It may contain things like DUI convictions, plea bargains, court decisions, or other matters. Although not all misdemeanors may be recorded, if you have a felony conviction, it's on your record.

Getting Your Records

In the state of North Dakota, you can obtain records based on a name search or fingerprint search. The fingerprint search gives you a more detailed record because it doesn't matter what name the defendant was booked under. Even if someone used a number of aliases, fingerprints do not lie.

What Information is Required?

You must include the person's full name. If you know of maiden names or aliases, this will give you a more complete record search. Include the birth date and SS number. Unless all three of these things match, records are not released to you. If you are requesting a fingerprint-based search, you must provide fingerprints. Here is a link to the official form you must use.
Include the mailing address of the person you are requesting the information from. If you include a signed authorization form, an address is not required. An address is needed for non-authorized requests because they are required to notify the person that you obtained his or her records. The mailing address is:
"North Dakota Bureau of Criminal Investigation
Criminal Records Section
4205 State Street
P.O. Box 1054
Bismark, ND 58502-1054"
Make sure to include the $15.00 fee with the completed form. Make the check or money order out to "ND Attorney General." If you represent an authorized not for profit organization, you may qualify for the reduced fee of $5.00 You'll need to submit an application form with your request form.
Public schools can use this form for requesting either state or FBI criminal records. Fingerprints must also be included in the request.
After mailing in your North Dakota criminal records request, it can take as long as ten days to process. An expedited service is available if you include a SASE with overnight or expedited postage and payment must be a money order or cashier's check. Certified or notarized records must include a written request. For more info, you can call the Secretary of State office a 1-701-328-2901.
