If you would like to do a background check on someone or you're interested in viewing your own criminal record, you have several options in the state of Montana. For instance, Montana has privacy laws that limit the kind of information the general public can receive and here are some good things to know about the process.

What is a Criminal Record?

A criminal record or background check may include a number of things. A typical record may cover felony or misdemeanor convictions. Driving records are restricted to felony convictions only. A criminal history report may cover indictments, arrests, charges, sentencing, and probation issues.
Due to privacy laws, the general public cannot access records like dismissed or deferred criminal cases.

What Kind of Records are Available?

You can request records based on fingerprint or name searches. A name-based request only covers what is available to the general public. You can search for information by name, Social Security numbers, or birth dates.
Fingerprint based background checks are the most comprehensive and complete records available. They also include neighboring states of Nevada, Utah, Idaho, Wyoming, Washington, and Alaska. However, these records are not available to the public. Only those people or organizations with the proper authorization may access them.
Records can be accessed online or through the mail.

Internet Name-based Background Checks

To access a background check based on name, anyone can visit the CHOPRS site CHOPRS stands for Criminal History Online Public Record Search. All you need to do is select "Public Users" and the button that says, "Start Service."
For a successful records search, you'll need the birth date and complete name of the subject. If you want a thorough search, include the SS numbers if available. You can also include as many as four known aliases in your search for no additional charge. Montana law requires that you include your name in the search. The fee for the service is $14.50, and they accept eCheck and charge card payments.
If you are a registered user, you can log into the system for access. This requires a monthly fee.

Name-based Checks by Mail

You don't need a special form, but you must include the subject's name, date of birth, and SS numbers. Mail your $13.00 fee to:
"Montana Criminal Records
P.O. Box 201403
Helena, MT 59620-1403"
Don't forget to enclose a SASE.

Fingerprint-based Background Checks (State of Montana)

You cannot access this data online. It has to be in person or by mail.

Mail Requests

An applicant fingerprint card is required. You can get cards from the Montana Criminal Records Division. Make sure that the fingerprint technician and the subject both sign the card. The fee is $10.00 and you'll need to include a SASE. The mailing address is the same as the name-based requests address.

In Person

You'll need to visit the Criminal Records and Identification Services Section of the Montana Department of Justice between the hours of 8:30 am and 4:30 pm. The address is:
